Poland Adopts the National E-invoice System Draft Legislation

The Polish government has adopted the National E-invoice System (KSeF) draft legislation with the objective of accelerating digital transformation.

KSeF e-invoicing has been available for Polish taxpayers voluntarily since January 2022. The obligation to issue e-invoices will be effective on July 1, 2024. It will apply to Business-to-Business (B2B) transactions with or without VAT. Business-to-Consumer (B2C) transactions are excluded from the first phase of the new e-invoicing obligations.

The new system will simplify the process of documenting transactions and will accelerate and automate issuing, processing and archiving documents. As a consequence, it will reduce costs for businesses. In addition, the KSeF allows taxpayers to have up-to-date (real-time) information from invoices for management purposes.

The legislation also provides for the introduction of electronic handling of binding information, such as Binding Tariff Information (BTI), Binding Information on Origin (WIP), Binding Excise Information (WIA), and Binding Rate Information (WIS). The existing tools and IT systems of the Polish National Revenue Administration (KAS) will be extended and no technological implementation by taxpayers is required.

Polish taxpayers are advised to prepare their invoicing systems and IT infrastructure to issue and receive e-invoices.
