Brazil has confirmed that the national NFS-e for digital platforms becomes mandatory on December 1, 2026, in addition to the wider electronic invoicing changes arriving on January 1, 2027.
For digital platforms and the foreign businesses that sell through them, this is a short runway with real consequences. The new rules introduce specific scenarios where a platform can become liable for tax it never used to touch, and several of the practical requirements for nonresident sellers are still awaiting guidance from the authorities.

Platform liability is scenario-specific, not automatic. The rules do not make a platform liable for every transaction it intermediates. Liability arises in defined situations, most notably imports carried out through the platform and cases where required transaction information or fiscal documents are missing. Knowing which scenarios apply to your business is the first step to scoping the work.
The foreign-seller mechanics are still being written. Platforms domiciled outside Brazil are inside the IBS and CBS registration framework, but the operational process for registration, onboarding, and transmission for nonresident issuers has not been fully explained. Teams should prepare against what is confirmed while tracking guidance from the RFB and CGIBS.
The compliance programme adds flexibility, not more time. Brazil's 2026 National Tax Compliance Programme takes a supportive approach to the transition, with monitoring, communication, and voluntary correction, alongside the existing 60-day regularisation period. It does not move the e-invoicing deadlines. December 1 still stands.
